QwikCash ATM Agreement

By signing the application at the end of this form, you acknowledge you have requested a QwikCash ATM card and a personal identification number (PIN) to be issued to your to access funds on deposit with this credit union. You agree that the use of the card shall be governed by the terms, conditions and disclosures contained in this agreement. The terms and conditions governing the account(s) accessed by your card and PIN also are applicable. In the event of a conflict between the disclosures and the terms and conditions governing the account(s), the disclosures shall govern.

Use of the card and PIN by you, anyone authorized by you or a joint owner of the account constitutes authorization for the credit union to charge your account for the amount of the transaction. I understand and agree that, unless otherwise agreed to by all parties to the account, any joint owner of an account which may be accessed by the card and PIN may request, receive and use a QwikCash card and PIN provided that the person requesting the card is the joint owner of all accounts which may be accessed by the card.

Any transaction which would result in a negative balance of the affected account shall be handled under the overdraft procedures applicable to that particular account or immediately paid to the credit union upon demand. In addition, you will be charged an overdraft fee of $15.00 to reimburse the credit union for the costs associated with processing such overdraft. The credit union may change this agreement from time to time by giving you written notice. If any change results in greater cost or liability to your or decreases access to your account(s), you will be given at least 21 days prior notice of the change. The credit union may cancel your card at any time. The card remains the property of the credit union and you agree to return the card to the credit union upon termination of this agreement or as otherwise requested by the credit union. If your card is lost or damaged and you desire issuance of a new card, you will be charged $5.00 for each such card. Statements, notices and any disclosures will be mailed to you at the most recent address you have given the credit union. If there is more than one owner of the account, notice sent to any one owner will be considered notice to all.

The following provisions are disclosures made under and in compliance with the Electronic Funds Transfer Act. The disclosures should be read carefully. They explain certain conditions under which the card is offered, as well as the protection afforded users of the card. These disclosures constitute pare of your contractual agreement with the credit union.

Types of Available Transfers and Limits on Transfers

You may use your card with your personal identification number (PIN) to (1) withdraw cash from your checking account or (2) pay for purchases at places that have agreed to accept the card; (3) balance inquiries are not available at this time. You may withdraw cash or make purchases up to the balance in the account(s) up to a maximum of $200 a day for ATM withdrawals and $200 for point-of-sale transactions. Monday through Friday you may withdraw cash or make purchases up to the balance in the account(s) up to a maximum of $200 a day for ATM withdrawals and $200 for point-of-sale transactions. Transactions on Saturday and Sunday will be combined and subject to a maximum of $200 for ATM withdrawals and $200 for point-of-sale transactions.

Disclosure of Charges For Transfers or Right to Make Transfers

We will charge you $1 for each cash withdrawal you make using your card at an automated teller machine. We will charge you $1 for each purchase you make using your card. We will charge you $1 for each balance inquiry attempted.

Disclosure of Right to Receive Documentation of Transfers

A transaction receipt will be available to you at the time you make any transaction involving withdrawals or transfers to or from your account using an automated teller machine or point-of-sale terminal which accepts your card. You will receive a monthly statement for each account accessed by your card. If no electronic transactions have occurred during a particular month, you will in any event receive a statement at least quarterly

Disclosure of Liability for Failure to Make Transactions

If we do not complete a transfer to or from an account on time or in the correct account according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance: if through no fault of ours you do not have enough money in the account to make the transfer; if the automated teller machine where you are making the transfer does not have enough cash; if the terminal system or system was not working properly and you knew about the breakdown when you started the transfer; and if circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken. There may be other exceptions stated in other agreements between us. Please examine all such agreements carefully.

Disclosure of Business Days

Our business days are Monday through Friday: 8:30 a.m. to 4:30 p.m. Holidays are not included.

Disclosure of Liability for Unauthorized Transfers

Contact us at once if you believe your card or PIN has been lost or stolen. Telephoning is the best way of keeping your possible losses down. Unless precautions are taken, under certain conditions you could lose all the money in your account plus, if applicable, additional losses resulting from an overdraft line of credit. If you tell us within two business days of when you discover a loss or theft, you can lose no more than $50.00 if someone uses the card without your permission. If you do not tell us within two business days, and we can prove we could have stopped someone from using that card without your permission if you had told us, you could lose as much as $500.00. Also, if any account statement was mailed to you, you may not get back any money you lost after the sixty (60) days if we can prove that we could have stopped someone from taking the money if you had told us in time. Unless Texas law is pre-empted by the Federal Electronic Fund Transfer Act, your liability for unauthorized point-of-sale transactions may be limited to $500.00 even if you fail t notify us of a loss or theft.

Error Resolution Disclosure

In case of errors or questions about your electronic transfers, telephone us at (409) 833-8271 or write: IBEW Local 479 Federal Credit Union, P.O. Box 20877, Beaumont, TX 77720-0877.

We must hear from you no later than sixty (60) days after we send the first statement on which the problem or error appeared.

1. Tell us your name and account number.

2. Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is in error or why you need more information.

3. Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days.

We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will re-credit your account within ten (10) business days for the amount you think is in error so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not re-credit your account. If the transaction you believe to be in error occurred at a point-of-sale terminal, then we may take up to twenty (20) days to investigate your claim. If we need more time, we may take up to ninety (90) days. If we decide to do this, we will re-credit the account in question within twenty (20) days of receiving your inquiry with the account you think is in error.

If we decide that there was no error, We will send you a written explanation within three business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

Notice of ATM User Precautions

As with all financial transactions, please exercise discretion when using an ATM. For your own safety, be careful. The following suggestions may be helpful.

Prepare for your ATM transactions at home (for instance, by filling out a deposit slip) to minimize your time at the ATM

Mark each transaction in your account record, but not while at the ATM. Always save your receipts. Don’t leave them at the ATM because they may contain important account information.

Compare your records with the account statements your receive.

Don’t lend your ATM card to anyone.

Remember, do not leave your card at the ATM.

Protect the secrecy of your Personal Identification Number (PIN). Don’t tell anyone your PIN. Don’t write your PIN where it can be discovered. For example, don’t keep a note of your PIN in your wallet or purse.

Prevent others from seeing you enter your PIN by using your body to shield their view.

If you lose your ATM card or if it is stolen, promptly notify us. You should consult the other disclosures you have received about electronic funds transfers for additional information about what to do if your card is lost or stolen.

When you make an ATM transaction, be aware of your surroundings. Look out for suspicious activity near the ATM facility, particularly if it is after sunset. At night, be sure that the ATM site (including the parking area and walkways) is well lighted. Consider having someone accompany you when you use the ATM after sunset. If you observe any problem, go to another ATM facility.

Don’t accept assistance from anyone you don’t know when using an ATM.

If you notice anything suspicious or if any other problem arises after you have begun an ATM transaction, you may want to cancel the transaction, pocket your card and leave. You might consider using another ATM or coming back later.

Don’ display your cash; pocket it as soon as the ATM transaction is completed and count the cash later when you are in the safety of your own car, home, or other secure surrounding.

At a drive-up ATM, make sure all the car doors are locked and all of the windows are rolled up, except the driver’s window. Keep the engine running and remain alert to your surroundings.

We want the ATM to be safe and convenient for you. Therefore, please tell us if you know of any problem with an ATM facility. For instance, let us know if a light is not working or there is any damage to a facility. Please report any suspicious activity or crimes to both the operator of the ATM and the local law enforcement officials immediately.
